u>WARRANTY TERMS & CONDITIONS
All products distributed by Better Backs Australia are covered by either a warranty or service guarantee for the set period and as listed on the original receipt for order A warranty only applies if stated on the receipt and if written by authorised staff or agents on an official Better Backs Australia receipt at the original time of order and subsequent final invoice as generated by internal admin unless subject to holiday or time consistent promotions. All products that are more than 50 Kilometres from an authorised repair centre shall have a limited warranty covering parts and labour only. Additional costs involved will be charged to the client and may include transport or call-out fees. When transporting goods using independent couriers, the item purchased must be placed in a suitable box and no liability is held by Better Backs Australia for damage in transit.

INDEPENDENT PART WARRANTY - 5 YEAR MOTOR WARRANTY
This warranty is designed to extend the term of coverage for the most consistently working parts of your product – The Motors!!
It guarantees the holder to a working replacement part for any motor faulting through regular use and covers the full cost of the replacement part or repair to original part only. Return of the original motor may be required. Major parts not mentioned on the receipt as part of the extended warranty coverage that become faulty, retain coverage against manufacturing faults for a minimum 12mths or as described on receipt and will be replaced in accordance with warranty terms set forth below or as provided by the part manufacturer. Included as part of an annual Holiday promotion all massage chairs sold from shopping centre display stands throughout the month of December will receive a FREE and automatic award of the 5 Year Motor Warranty

Any other time this facility must be itemized on the original receipt to register

LIFETIME SERVICE GUARANTEE
After the specified warranty period has expired and provided this guarantee is included on the receipts, products are then covered by a lifetime service guarantee. This service guarantee covers any reasonable repair request made as long as the item purchased is still owned by the original purchaser as set on the receipt. It covers work done by our authorised repair staff in our warehouse/service centres. It does not include in-home repairs, courier fees, parts, specialist repairers or any other expenses related to the defective item.

Where a specific part or other warranty is confirmed on final receipt for order (usually 5 year motor warranty) please see description of the warranty referenced for further details and overriding terms. Where only a duration is sited on the receipt and no specific part, then the warranty term referenced is pertaining to the replacement cost of the part only and is specific to the motor, air compressor and circuit board on the massage chair as well as the water circulating jets and light fitting on the spa only. Any additional parts that may fault including; the frame, pipes, fittings, seals, airbags, wiring and leather/PU/material covers, remote controls, drain pumps and light globes, are replaceable under the manufacturers minimum 12mth warranty and subject to the fault being through correct usage and in accordance with their process and approval for replacement/repair. We endeavour to keep all major parts in stock however if unavailable we may elect to order source or manufacture similar or equivalent functioning parts as needed and at the discretion of our technicians. Advice and troubleshooting via usage of emailed photos and video is sufficient for analysis or repair of most issues and is a service included throughout the term of your warranty. Also included in the warranty term are any time related expenses associated through the use of our own technicians when spent servicing, repairing or assessing faulty goods that have been returned by the client to our warehouse. Onsite repair work by our technicians and installers, transport costs or any work required by licensed tradesman is not included in the sale price or as part of the warranty. Leaking fittings including pipes, adaptors, parts and connections are not covered by warranty and if this occurs should be referred to a plumber or handyman for resealing, as required These units are designed with standard and generic pipes, fittings and connections and are intended for usage independent of mains water access. Components required to attach the spa to mains in/outlets hoses and drain are included for easy install to standard Australian fittings and come complete able to work with most fit outs on install and without the need for additional parts. Depending on the pipe designs, height of drainage, distance to mains and other store design factors as well as salon location requirements including need for additional safety components, oddly sized/placed access points or requirements for use with specific certified components to satisfy local regulations may incur the need for additional parts to be purchased or for the replacement of a portion of the existing components for compliance prior to official use. It is at the discretion and responsibility of your plumber/installer to arrange any additional parts or compliances required for your salon. Similar components are readily available at most major plumbing and hardware supply stores

TERMS/CONDITIONS//EXCLUSIONS/EXEMPTIONS
The warranty and guarantee is only applicable against manufacturing faults and will cease immediately on evidence of tampering, modifying or any unauthorised access to our products. The warranty and guarantee also excludes; malfunction or damage resulting from Acts of God, natural disaster, fire, pets, civil unrest and/or accidents. They also exclude usage in the wrong environment, usage of the product other than described in its manual, or usage with the wrong electrical supply. The warranty and guarantee do not pertain to negligence, abuse, fabric/cover, or accessories.
The warranty period commences at the time of delivery and for the period set forth on the original order/invoice. Repairs will be completed under conditions of warranty and with no limit to required call out or repair work done throughout the period authorized for coverage. At no stage will any item be refunded or exchanged due to faulty parts, damage, unsuitability or other circumstances once delivered and/or initial warranty has commenced. In the event that an item is within its warranty period and is deemed unrepairable, at the discretion of management, Better Backs Australia reserves the right to provide a credit note or exchange item for goods currently stocked and available at full retail for the equivalent price or higher. This option does not include items under lifetime guarantee coverage or other extended terms offered and is solely related to products and their initial warranty as described on receipt
We will endeavour to have repair requests initiated, actioned & completed within a reasonable time frame however delays can be caused due to availability of replacement parts, incorrect fault analysis and required technician schedules. Any time frame quoted for repair work to be done is an estimation only. Client will be contacted when repair is completed to confirm work done and arrange return of item. Better Backs Australia is not liable for any loss of profit or fees associated with items being unavailable during repair process
In the event that a faulty part is not available in stock, a suitable replacement will be ordered on your behalf and progress tracked. All due care is taken to ensure the part is manufactured or sourced in a reasonable time frame however with certain parts and manufacturers there can be delays in processing orders, subsequent additional faults found, replacement can be received damaged or not able to comply with older parts. Better Backs Australia can’t be held responsible for external circumstances such as these and will subsequently continue to pursue the correct part to complete repair as per warranty
If you are returning stock to our repair centres for repair, the item being returned must be delivered to us in a secure box, or arrangements made for it to be collected by our staff. We do not accept responsibility for damage done to your items in transit via couriers.
We guarantee to have in stock, be able to manufacture or source comparable parts for any replacement item that is needed to complete a repair for the set period of the warranty. Any replacement part provided or repair work completed may not be identical to original but will function in the equivalent ways or better. After the warranty period has expired, we will endeavour to attain any information or part required but are not accountable for delay in production, wrongful replacement parts sent, unavailability of repair information/part. We will endeavour to assist repair done out of warranty or under guarantee conditions but manufacturers may shut down, can refuse to produce or assist with repairs of past models and hinder our assistance causing delays or inability to supply required part,
Replacement parts & repairs completed under warranty do not adjust the original term or include its own warranty term New parts purchased after the warranty has expired include the manufacturers 12mth warranty, terms & conditions and does not include freight, provided this is indicated on receipt
Any work associated with product Installations or Repairs under Warranty & Guarantees conditions and described as an included part of this warranty or arranged to be provided by Better Backs Australia is referencing work done by our internal technicians and authorized handymen only. Where there is a requirement for certified technicians such as electricians, plumbers and reupholsters Better Backs Australia cannot be held liable for additional fees or quality of work provided and any additional warranty provided by the repairing technician should be attained in writing for future reference. Where possible our technicians may agree to complete the repair work required but at the clients risk and sole responsibility to have checked and approved by required technicians. Better Backs Australia internal staff are not qualified electricians or plumbers and all work provided is at the clients discretion to get checked and approved by certified technicians, if required neither the company or staff can be held liable for water, electric or fire damage caused by use of uncertified components or service by uncertified technicians as well as any loss of profit whilst items are being repaired. It is client responsibility to provide a clear path and adequate protection to house, salon, product and contents to avoid damage during onsite repairs or removals no responsibility is taken for damage caused t once entry past the door has been requested or authorized
Any outstanding fees, invoices and account balances associated with order must be paid immediately on invoicing unless payment extensions are authorized in writing. If accounts are not paid within 7days of formal request additional services, remaining warranty and other future obligations under contract may be cancelled or voided at the suppliers discretion
Warranty will commence from the date of product delivery and unless provided with a signed printout of the full details of specific warranty in order to authenticate and initiate warranty the classification and duration must be recorded on both the original order and final receipt provided once item is delivered
Where product use is intended for rehabilitation purposes, with the intention of set health results or by persons suffering any medical ailment, injury or physical limitations Better Backs Australia can not be held responsible for unattained results, negative reactions or other effects caused through use of products offered. Staff recommending available technologies, solutions or methods of use and training programs are issuing advice based on product training, previous client experiences and relevant studies conducted. It is clients responsibility to seek medical advice and apprroval prior to ordering if concerned by reactions or suffering any ailments or limitations. Refunds will not be authorized after item is delivered based on products deemed not suitable or ineffective for conditions intended. At the suppliers discretion a credit note or trade in may be authorized in these circumstances against the full retail price of other items stocked
Our liability for a breach of a condition or warranty implied by DIV2 of Pt V of the Trade Practices Act 1974 is hereby limited at our option to the replacement of the item or the supply of an equivalent item, the payment of replacing the item or supplying an equivalent item, the repair of the item or the payment of the costs of having the item repaired and to the maximum extent permitted by law, our liability for a breach of any other condition or warranty (express or implied) other than any warranty contained herein is specifically excluded.
Without limiting the generality of the foregoing, we will not, under any circumstances, be liable to you for any indirect, special or consequential loss or damage of any nature whatsoever.
